Agreement to These Terms
These Terms of Service (the “Terms”) govern your use of the website of AL Media Group LLC (“AL Media Group,” “we,” “us,” or “our”) and set the general framework for our media and event production services, including photography, videography, content creation, and event production and audiovisual work. By using this website or engaging us for a project, you agree to these Terms. If you do not agree, please do not use the website or our services.
Each project we take on is described in its own written proposal, quote, or agreement. Where that project agreement and these Terms cover the same topic, the signed project agreement controls for that project.
Projects, Quotes & Proposals
Work typically begins with a proposal or quote outlining the scope, deliverables, schedule, and pricing for your project. Quotes are valid for the period stated and may change if the scope, dates, or requirements change. A project is confirmed once you accept the proposal and pay any required deposit. Requests to add work after a project is confirmed may affect the price and timeline and may be handled as a separate proposal.
Booking, Deposits & Payment
A deposit may be required to reserve your date and secure our team and equipment. Because a booking reserves time we could otherwise offer to other clients, deposits are generally non-refundable unless your proposal states otherwise. The remaining balance is due on the schedule set out in your proposal.
Out-of-pocket costs such as travel, permits, rentals, and third-party services may be billed as agreed. Invoices are due by the date shown. Late payments may pause work or delivery and may be subject to a late fee where permitted by law.
Cancellations, Rescheduling & Postponement
If you cancel a confirmed project, any deposit is forfeited and you remain responsible for work performed and expenses committed up to the cancellation. Rescheduling is subject to our availability. For events, a date may need to be moved due to weather, venue issues, or other circumstances beyond either party’s control, as described in the Force Majeure section below. Specific cancellation and rescheduling terms for your project are set out in your proposal.
Your Responsibilities
As a client, you agree to:
- Provide accurate information and timely feedback, approvals, and materials so we can meet the schedule.
- Give our crew safe and reasonable access to the location, with adequate space, power, and time to set up and work.
- Obtain any venue permissions, permits, or approvals needed for the shoot or event, unless we have expressly agreed to handle them.
- Designate a point of contact who can make decisions during the project or event.
- Coordinate any third-party vendors and let guests know that photography or video may take place.
Permissions & Releases
You confirm that you have the right and any necessary permission for the people, locations, logos, artwork, music, and other materials you ask us to capture or include. You are responsible for obtaining required releases and permits, except where we agree in writing to handle them. You agree to hold us harmless from claims arising from materials or permissions that were your responsibility.
Ownership & Licensing of Deliverables
Upon receipt of full payment, you receive the rights to use the final delivered photos and videos for the purposes described in your proposal. Unless your project agreement says otherwise, we retain ownership of raw and unedited footage, outtakes, project and working files, and any tools, presets, or templates we created before or apart from your project.
Uses beyond what your proposal covers, such as expanded commercial use, resale, or licensing to third parties, may require a separate written license. Please keep our credit intact where practical and do not alter delivered work in a way that misrepresents it.
Portfolio & Promotional Use
Unless we agree otherwise in writing, we may display and share the work we create for you in our portfolio, on our website and social media, and in other marketing. If a project is confidential or sensitive, tell us in writing before we begin and we will agree on reasonable restrictions.
Deliverables, Timelines & Revisions
Delivery formats and timelines are described in your proposal and begin once we have everything we need from you. A project may include a set number of revision rounds; additional revisions or changes in scope may be billed separately. Final files are delivered digitally. We recommend you back up your delivered files, as we may archive projects for a limited time but do not guarantee indefinite storage.
Equipment & On-Site Conduct at Events
Our team provides and operates its own equipment and works to do so safely and professionally. At your event, you are responsible for loss of or damage to our equipment caused by your guests, other vendors, or venue conditions outside our reasonable control. If a location or situation is unsafe, we may pause or stop work until it is resolved.
Force Majeure
Neither party is responsible for delays or failure to perform caused by events beyond its reasonable control, including weather, natural disasters, fire, illness, labor issues, government action, venue closures, or power and internet outages. If such an event occurs, we will work with you in good faith to reschedule, and any effect on payments will be handled as set out in your proposal.
Limitation of Liability
We provide our services with professional care. To the fullest extent permitted by law, our total liability for any project is limited to the amount you paid us for that project, and we are not liable for indirect, incidental, consequential, or special damages, including lost profits or lost opportunities. Some jurisdictions do not allow certain limitations, so some of these may not apply to you.
Indemnification
You agree to hold harmless and, where applicable, indemnify AL Media Group from claims, damages, and costs arising out of materials or permissions that were your responsibility, your breach of these Terms, or the conduct of you or your guests at an event.
Use of This Website
You may use this website for lawful, personal, and business purposes only. You agree not to misuse the site, attempt to disrupt it, or copy, scrape, or reuse its content without permission. All content on this site, including text, photography, video, graphics, logos, and design, is owned by AL Media Group or its licensors and is protected by intellectual property laws. The website and its content are provided on an “as is” basis without warranties of any kind, and links to third-party sites are provided for convenience and are not under our control.
Governing Law
These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws rules. Any dispute relating to these Terms or our services will be handled in the state or federal courts located in Miami-Dade County, Florida, and we encourage you to contact us first so we can try to resolve the matter directly.
Changes to These Terms
We may update these Terms from time to time. When we do, we will revise the date at the top of this page. Your continued use of the website or our services after changes take effect means you accept the updated Terms.
